Under Article 154A paragraph (1) letter c of Law No. 13 of 2003 on Manpower, as amended by Law No. 6 of 2023 on Job Creation, an employment relationship may be terminated when an employee reaches the retirement age as specified in the employment agreement, company regulations, or collective labor agreement.

This means that retirement is a legally recognized ground for the termination of employment.

Can Employment Be Extended After Retirement?

Although employment may end upon retirement, Indonesian labor regulations do not prohibit companies from rehiring or extending the employment of retired employees, provided that both parties agree to continue the working relationship.

In practice, employers may establish a new employment agreement, either under a Fixed-Term Employment Agreement (PKWT) or an Indefinite-Term Employment Agreement (PKWTT), while ensuring compliance with applicable labor laws.

As a result, retired employees may continue working if the company still requires their expertise and the employee is willing to remain employed.

What Is the Retirement Age in Indonesia?

For the BPJS Employment Pension Program (Jaminan Pensiun), the retirement age is governed by Government Regulation (PP) No. 45 of 2015 on the Administration of the Pension Security Program, which provides for gradual adjustments to the pension age over time.

However, it is important to note that the BPJS pension age is not necessarily the same as a company’s mandatory retirement age. Many employers establish retirement ages of 55, 56, 58, or 60 years old based on their internal policies and employment regulations.
